Terms of Service

Important: These Terms were prepared with care and reflect real Canadian and U.S. legal obligations that apply to this platform, but they have not been reviewed by a lawyer licensed in Alberta. Because this is an adult platform with a global audience and cross-border hosting, several areas below (age-verification law, U.S. record-keeping, cross-border data transfer) carry real legal risk and should be reviewed by qualified counsel before being relied upon as final.
1. Who operates this site
Crimson After Hours (the "Site") is operated by FumikoEcho Network, a sole proprietorship based in Alberta, Canada ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the Site. They incorporate our Privacy Policy and Copyright Policy by reference.
2. Acceptance
By accessing the Site, creating an account, or uploading content, you agree to these Terms. If you do not agree, do not use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind it.
3. Age and eligibility
The Site contains adult (nsfw) content and is strictly limited to adults.
- You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account or access adult content.
- Access to adult content requires successfully completing our third-party age-verification process (currently provided by Persona, using government-ID and/or biometric selfie checks). We do not rely on a self-declared checkbox for adult content.
- You are responsible for ensuring that accessing adult content is lawful where you are. Age-verification and adult-content laws vary by jurisdiction and are changing rapidly (for example, several U.S. states and the United Kingdom now mandate "highly effective" age verification). Where we are required to restrict or block access based on your location, we may do so.
- Providing false age or identity information, or helping a minor access adult content, is a serious violation of these Terms and, in many places, a criminal offence.
4. Accounts
You are responsible for your account credentials and all activity under your account. Provide accurate information, keep your email current, and notify us promptly of unauthorized use. We may suspend or terminate accounts under Section 8.
5. Content you upload — your license and your promises
5.1 License. You keep ownership of what you upload. You grant us a non-exclusive, worldwide, royalty-free license to host, store, transcode, reproduce, display, and distribute your content solely to operate and promote the Site. This license ends when you or we remove the content, except for backups retained for a reasonable period and records we must keep by law.
5.2 Your representations. For everything you upload, you represent and warrant that:
- You own it or have all rights, licenses, consents, and releases needed to upload and license it, including the informed consent of every identifiable person depicted;
- Every person depicted in sexually explicit content was at least 18 years old at the time of production, and you have verified this and retain records proving it. Under U.S. law (18 U.S.C. § 2257), the producer of sexually explicit visual content must create and keep age/identity records for each performer. As the person who created and uploaded the content, you are the producer and you are responsible for maintaining those records; we host user-generated content and are not the primary producer of it;
- The content does not depict, and is not designed to resemble or suggest, a person under 18 in any sexual context, in any medium — including illustrated, animated, AI-generated, or stylized depictions. This is absolute and independent of the content's legality anywhere;
- The content is not an "intimate image" of any person published without their consent. Publishing an intimate image of someone without their consent is a criminal offence in Canada (Criminal Code s. 162.1) and is strictly prohibited here;
- The content does not infringe anyone's copyright, trademark, privacy, or publicity rights;
- The content complies with applicable law, including the Criminal Code of Canada.
6. Prohibited content and conduct
The following are never permitted, regardless of legality elsewhere. Violations result in removal, account termination, and — where the content may involve the sexual exploitation of a minor — a report to the Canadian Centre for Child Protection and, because our servers are in the United States, to the U.S. National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A:
- Any content sexualizing a person under 18, or appearing to, in any medium or art style;
- Non-consensual content, including "revenge porn" and any intimate image shared without the depicted person's consent;
- Content depicting non-consensual acts, bestiality, incest, or content promoting sexual violence;
- Content that facilitates sex trafficking or the exploitation of any person;
- Content infringing another's intellectual property (see our Copyright Policy);
- Harassment, doxxing, threats, or hate speech;
- Circumventing age verification, moderation, or account sanctions; scraping; malware; or spam.
7. Moderation and how we handle content
Every explicit upload is reviewed by a human moderator before it can be published, and we run automated scanning intended to detect known child sexual abuse material. We may remove content, refuse publication, or restrict access at our discretion, without prior notice, where necessary to comply with law, enforce these Terms, or prevent harm. We are not obligated to monitor all content proactively, but we act on what we become aware of.
8. Enforcement, suspension, and appeals
We may issue warnings, temporary suspensions, or permanent bans through the tiered enforcement process built into the Site. If you are sanctioned you may submit an appeal from your account; appeals are reviewed by staff and are not guaranteed to succeed. We may act without prior notice where necessary to prevent harm or comply with law.
9. Copyright
We operate under Canada's "notice-and-notice" copyright regime and also review infringement complaints on their merits. See the Copyright Policy for how to submit a complaint or counter-notice.
10. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
11. Limitation of liability
To the maximum extent permitted by law, FumikoEcho Network will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless FumikoEcho Network from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your breach of these Terms, or your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of Alberta. This does not deprive you of the protection of mandatory consumer-protection laws of your own jurisdiction where those apply.
14. Changes
We may update these Terms. Material changes will be reflected in the "Last updated" date; continued use after changes take effect is acceptance of the revised Terms.
